This Privacy Policy explains how Factory Source Beauty Supply (“Factory Source,” “we,” “us,” or “our”), a business registered in Ghana with its shop at Okaishie Market, Accra, Greater Accra, Ghana, collects, uses, stores, shares, and protects your personal data when you use our website at factorysourcebeautysupplies.com, buy from our shop, place an order, or otherwise interact with us.

We are committed to protecting your privacy in compliance with the Data Protection Act, 2012 (Act 843) of Ghana (“the Act”). By using this website and providing your personal data, you consent to the collection and use of your information as described in this Privacy Policy.

3.1 Information You Provide. When you place an order, create an account, or contact us, we may collect: (i) your full name; (ii) your email address; (iii) your telephone number; (iv) your delivery location; and (v) any other information you choose to give us. In our shop, giving your name or phone number is optional; we record it with your sale if you give it.

3.2 Payment Information. Where you pay online, your card or Mobile Money details are collected and processed directly by our payment provider. Factory Source does not collect, store, or have access to your full card details or Mobile Money PINs. For Mobile Money sent to our number, we see the sender name, number and transaction reference that the network shows us.

3.3 Information Collected Automatically. When you visit our website, certain technical information may be collected automatically, including: (i) your IP address; (ii) browser type and version; (iii) device type; (iv) pages visited; and (v) the referring website address. This information is collected through server logs, our hosting provider’s visitor statistics (which do not use cookies), and the cookies described in section 9.

We use your personal data: (i) to process and fulfil your orders, including collection and delivery; (ii) to send you order confirmations, ready-for-collection and delivery messages, and other transactional communications by SMS, WhatsApp or email; (iii) to deal with enquiries, returns, refunds, and customer support; (iv) to create and manage your account; (v) to improve our website, products, and services; (vi) to detect and prevent fraud or unauthorised activity; and (vii) to comply with our legal obligations.

We process your personal data on the following grounds under the Act: (i) your consent; (ii) the performance of a contract, where processing is needed to fulfil your order; (iii) compliance with a legal obligation under the laws of Ghana; and (iv) our legitimate interests in operating, securing, and improving our business, provided those interests are not overridden by your rights and freedoms.

6.1 Promotional Messages. We may send you offers or updates about our products by SMS, WhatsApp or email, but only where you have consented or we are otherwise permitted to by law.

6.2 Opt-Out. You may stop marketing messages at any time by following the instructions in the message or by contacting us at shop@factorysourcebeautysupplies.com. This does not affect messages about your orders.

We do not sell, rent, or trade your personal data. We share it only with the following, and only as far as needed for the purposes in this policy:

7.1 Payment Processing. Where you pay online, we share transaction details with our payment provider to process and verify your payment. It handles your payment information under its own privacy policy and terms.

7.2 SMS and Messaging. We share your phone number and order details with our SMS provider to send you order messages.

7.3 Delivery. If you choose courier delivery, we share your name, phone number and delivery location with the rider or courier carrying your order.

7.4 Website Hosting and Infrastructure. Our website is hosted by a third-party hosting provider and our customer database by a third-party cloud database provider. Their servers are located outside Ghana, so your data may be stored and processed in the United States, the European Union, or other places where their infrastructure is located.

7.5 Legal and Regulatory. We may disclose your personal data where required by law, regulation, legal process, or an enforceable request from a government authority, or where needed to protect the rights, property, or safety of Factory Source, our customers, or others.

7.6 Advertising. We do not currently use advertising or conversion-tracking tools (such as the Google tag or the Meta Pixel) on this website, and we do not share your data with advertising platforms. If we start using them, we will update this policy before they are switched on.

Your personal data may be transferred to and processed in countries outside Ghana, including the United States and the European Union, through the service providers described in section 7. These countries may have data protection laws that differ from Ghana’s.

Where we transfer your personal data outside Ghana, we take reasonable steps to ensure it is treated securely and in accordance with this policy and the Act, including by using providers that maintain appropriate technical and organisational security measures.

9.1 What We Use. Our website uses cookies and similar browser storage for essential functions: keeping you signed in, remembering your cart and language, and supporting the security of checkout. These are necessary for the website to work.

9.2 No Advertising Cookies. We do not set advertising or tracking cookies. If that changes, this section will be updated first.

9.3 Your Choices. You can manage or delete cookies through your browser settings. Disabling essential cookies may stop parts of the website, such as the cart or checkout, from working.

We keep personal data only for as long as needed for the purposes it was collected for, including legal, accounting, and reporting requirements: (i) order and sales records are kept for at least six years to meet tax and commercial record-keeping requirements under the laws of Ghana; (ii) account information is kept while your account is active and for a reasonable period afterwards; and (iii) support correspondence is kept for as long as needed to resolve your enquiry.

When personal data is no longer needed, we securely delete or anonymise it.

We use reasonable technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction, including encrypted connections (HTTPS), access controls on our database and systems, and service providers with recognised security standards.

No method of transmission over the internet or of electronic storage is completely secure, so we cannot guarantee absolute security.

Under the Act you have the right: (i) to be informed about how your personal data is collected and used; (ii) to access the personal data we hold about you; (iii) to have inaccurate or incomplete data corrected; (iv) to ask for your data to be deleted, subject to legal obligations to keep it; and (v) to object to or restrict processing in certain circumstances.

Our website and services are not directed at anyone under 18. We do not knowingly collect personal data from children; if we learn that we have, we will delete it promptly.

We may update this policy to reflect changes in our practices, technology, or legal requirements. We will post a notice on this website at least 7 days before material changes take effect, and post the updated policy with a revised effective date. Continuing to use the website after changes take effect means you accept the updated policy.
