These Terms and Conditions govern your access to and use of the website factorysourcebeautysupplies.com, our shop at Okaishie Market, Accra, Greater Accra, Ghana, and any related sales channels operated by Factory Source Beauty Supply (“Factory Source,” “we,” “us,” or “our”), a business registered in Ghana.

By accessing this website, placing an order, or otherwise transacting with Factory Source, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, you must not use this website or place any orders.

2.1 Age Requirement. You must be at least 18 years of age to make a purchase through this website. By placing an order, you represent and warrant that you meet this requirement.

2.2 Accuracy of Information. You agree to provide accurate, current, and complete information when placing an order, creating an account, or otherwise interacting with this website.

3.1 Product Descriptions. We make reasonable efforts to ensure that product descriptions, images, and specifications displayed on this website are accurate. However, we do not warrant that product descriptions, colours, images, or other content are error-free, complete, or current. Slight variations in colour or appearance may occur due to screen display settings.

3.2 Availability. All products are subject to availability. Stock shown on this website is shared with our shop, so an item can sell out in the shop before your order is confirmed. We reserve the right to discontinue any product at any time without prior notice.

3.3 Product Use. Hair tools and electrical products must be used in accordance with the manufacturer’s instructions. Factory Source accepts no liability for damage, injury, or loss resulting from misuse, improper handling, or failure to follow the manufacturer’s instructions.

3.4 Manufacturer Warranties. Certain products may carry a manufacturer’s warranty. Where a manufacturer’s warranty applies, its terms and duration are set by the manufacturer, not by Factory Source. We will assist you in directing any warranty claim to the relevant manufacturer but do not independently warrant the products beyond what is required by applicable law.

4.1 Our Prices. Every product has a fixed shelf price. The wholesale price applies (i) to any product you buy 12 or more of in one order, counting all of its colours, sizes and styles together; and (ii) to every product in your order once the order, priced at wholesale, reaches GHS 1,000. The price that applies is calculated automatically and shown to you before you pay. Prices are not negotiable.

4.2 Order Placement. An order placed through this website constitutes an offer to purchase the selected products. We reserve the right to accept or decline any order at our sole discretion, including where: (i) the product is out of stock; (ii) there is a pricing or product description error; (iii) we are unable to verify your payment; or (iv) we suspect fraud or unauthorised activity.

4.3 Order Confirmation. An order is confirmed and a binding contract is formed only when we send you an order confirmation by SMS, email, WhatsApp or another communication channel. Until that point, no contract exists between you and Factory Source.

4.4 Currency and Changes. All prices are in Ghanaian Cedis (GHS) unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders that have already been confirmed.

4.5 Payment Methods. We accept Mobile Money and, at our shop, cash. Where online payment is offered at checkout, it is processed by our payment provider. All payments must be received in full before an order is released for collection or dispatch.

4.6 Payment Security. Online payments are subject to our payment provider’s own terms of service and security protocols. Factory Source does not store your card details or Mobile Money PINs.

5.1 Collection. You may collect your order from our shop at Okaishie Market, Accra, Greater Accra, Ghana. We will tell you when it is ready. Please bring your order number.

5.2 Courier Delivery. Factory Source does not operate its own delivery fleet. If you choose courier delivery, you send us your location after ordering and we tell you the fare of a third-party rider or courier. Nothing is dispatched until you agree to that fare, and you pay it directly to the rider when your order arrives. Delivery fares are set by the rider or courier, not by us.

5.3 Delivery Timeframes. Because delivery is handled by independent third-party riders and couriers, Factory Source does not control and cannot guarantee specific delivery dates or transit times once an order has been handed over.

5.4 Risk of Loss. Risk of loss and damage to products passes to you when you collect your order at our shop or when the order is handed over to the rider or courier for delivery.

5.5 Dispatch Confirmation. When your order is handed to a rider or courier, we will give you the details we have of the handover, such as the rider’s name and telephone number, or a tracking number where the courier provides one. You are responsible for using this information to follow up on your delivery.

5.6 Lost or Undelivered Orders. If your order does not arrive within a reasonable period, you must notify us within 14 days of dispatch. We will give you the handover details we hold to support your enquiry with the rider or courier. Our obligation is limited to that reasonable assistance; we are not liable for the value of orders lost or damaged after risk has passed to you under section 5.4.

5.7 Full Terms. Collection and delivery are subject to our separate Collection & Delivery Policy, available on this website, which forms part of these Terms and Conditions.

6.1 Return Window. You may request a return within 7 days of receiving your order, provided the item is unused, in its original condition, and in its original packaging with all accessories, tags, and proof of purchase.

6.2 Non-Returnable Items. Certain items are not eligible for return, including opened or used hair accessories and consumable hair care products.

6.3 Defective or Damaged Items. If you receive a defective, damaged, or incorrect item, you must notify us within 48 hours of receiving it with your order number, a description of the issue, and photographs or video evidence.

6.4 Refund Processing. Approved refunds are processed within 7 to 14 business days to the original payment method or another mutually agreed method.

6.5 Full Terms. Returns, refunds, and exchanges are subject to our separate Return and Refund Policy, available on this website, which forms part of these Terms and Conditions.

7.1 Account Creation. You can order without an account. If you create one, you agree to provide accurate and complete information and to keep it up to date.

7.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activity under your account. You must notify us immediately at shop@factorysourcebeautysupplies.com if you become aware of any unauthorised use of your account or any other breach of security.

7.3 Account Suspension and Termination. We reserve the right to suspend or terminate your account at any time if we reasonably believe that: (i) you have breached these Terms and Conditions; (ii) your account has been used for fraudulent or unauthorised activity; or (iii) continued access to your account poses a security risk. We will make reasonable efforts to notify you before or promptly after any suspension or termination, unless doing so would compromise security or an ongoing investigation.

8.1 Ownership. All content on this website, including text, graphics, logos, images, product photographs, and software, is the property of Factory Source Beauty Supply or its licensors and is protected by applicable intellectual property laws.

8.2 Restrictions. You may not reproduce, distribute, modify, display, create derivative works from, or otherwise use any content from this website for commercial purposes without prior written consent from Factory Source.

By using this website, you agree not to: (i) use the website for any unlawful purpose or in violation of any applicable law; (ii) interfere with or disrupt the operation of the website or its servers; (iii) attempt to gain unauthorised access to any part of the website; (iv) submit false, misleading, or fraudulent orders or information; or (v) use automated tools to scrape, extract, or collect data from the website without our prior written consent.

Your personal data is collected, processed, and stored in accordance with our Privacy Policy, available on this website, and in compliance with the Data Protection Act, 2012 (Act 843) of Ghana. By using this website and placing orders, you consent to the collection and use of your information as described in the Privacy Policy.

11.1 Payment Providers and Couriers. Our website works with third-party service providers, including our payment provider and independent riders and couriers. These providers operate under their own terms and privacy policies. Factory Source is not responsible for the acts, omissions, or policies of any third-party service provider.

11.2 External Links. This website may contain links to third-party websites. We do not endorse, control, or accept responsibility for the content, privacy practices, or terms of any linked third-party websites.

12.1 General Limitation. To the fullest extent permitted by the laws of Ghana, Factory Source Beauty Supply, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunity, or goodwill, arising out of or in connection with your use of this website or purchase of any product.

12.2 Maximum Liability. Factory Source’s total cumulative liability to you in connection with any order shall not exceed the total amount you paid for that specific order.

12.3 Force Majeure. Factory Source shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including natural disasters, pandemics, government restrictions, power outages, internet or telecommunications failures, courier delays, civil disturbance, or acts of war.

13.1 Website Availability. This website is provided on an “as is” and “as available” basis with respect to its operation and availability. Factory Source does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

13.2 Product Warranties. To the fullest extent permitted by applicable law, including the Sale of Goods Act, 1962 (Act 137), Factory Source disclaims all warranties, express or implied, that are not required by statute. Nothing in these Terms and Conditions is intended to exclude or limit any statutory rights you may have as a consumer under the laws of Ghana, including implied conditions as to merchantability or fitness for a particular purpose where such conditions cannot be lawfully excluded.

You agree to indemnify, defend, and hold harmless Factory Source Beauty Supply, its owners, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your breach of these Terms and Conditions; (ii) your misuse of the website or any product purchased; or (iii) your violation of any applicable law or the rights of any third party.

15.1 Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.

15.2 Dispute Resolution. Any dispute arising out of or in connection with these Terms and Conditions shall first be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may submit the matter to the courts of competent jurisdiction in Accra, Ghana.

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Factory Source reserves the right to update or modify these Terms and Conditions at any time. We will notify you of material changes by posting a notice on this website at least 7 days before the changes take effect. For non-material changes, the updated Terms and Conditions will be posted on this website with a revised effective date. Your continued use of the website after any changes take effect constitutes your acceptance of the updated Terms and Conditions.

These Terms and Conditions, together with our Privacy Policy, Collection & Delivery Policy, and Return and Refund Policy, constitute the entire agreement between you and Factory Source Beauty Supply with respect to your use of this website and purchase of products.
